Terms & Conditions

Introduction

Museum Amersfoort will do everything reasonably possible to ensure that visits to the
museum complex and the exhibitions and activities organised by Museum Amersfoort
proceed in accordance with the visitor’s wishes. Museum Amersfoort will, as far as possible,
endeavour to minimise any inconvenience or discomfort for visitors, and to
ensure their safety as far as possible.

1. Definitions and general provisions

_Article 1.1 _
The terms ‘the museum’ and ‘Museum Amersfoort’ refer to the organisation that manages
and operates the museum complex, including, but not limited to, the management, curators,
attendants and other museum staff authorised to act on behalf of this organisation.

_Article 1.2 _
‘The museum complex’ refers to the entirety of spaces (built and unbuilt) that fall under
the legal or managerial authority of the management of Museum Amersfoort, including,
but not limited to, exhibition halls, auditoriums and meeting rooms, the restaurant, café, terrace,
garden, park, other outdoor areas, the storeroom and annexes.
_Article 1.3 _
The term ‘visitor’ refers to any person who, in any way whatsoever, whether directly or indirectly, enters into an agreement with Museum
Amersfoort for the purpose of entering the museum complex and/or visiting an
exhibition or attending an activity organised by Museum Amersfoort
for the general public during normal opening hours.

_Article 1.4 _
These General Terms and Conditions of Visit apply to any agreement between Museum
Amersfoort and a visitor. Unless otherwise agreed, these terms and conditions do not apply to
special events held outside normal opening hours and/or aimed at visitors other than the general
public, such as in the case of room hire, catering services and the like.

_Article 1.5 _
The applicability of these Terms and Conditions of Visit does not affect the possible applicability of other
(contractual) terms and conditions and/or regulations of Museum Amersfoort.

2. Ticket sales, offers and prices

_
Article 2.1 _
All price quotations, announcements or other information provided by Museum Amersfoort are
in principle binding, and Museum Amersfoort accepts liability for any errors made by the museum
itself in price quotations, announcements or other
information provided to the visitor. However, this liability applies exclusively to the museum’s own information material that is present within
the museum at the time of the claim, or that has recently been distributed by or on behalf of Museum
Amersfoort. Museum Amersfoort is not liable for errors attributable to wilful misconduct,
fault or negligence on the part of third parties.

_Article 2.2 _
Visitors must hold a valid admission ticket whilst on the museum premises. They are at all times
obliged, upon request, to present their admission ticket and any card or voucher entitling them to a discount on the
admission price to officials recognisable as such, including but not limited to,
attendants and security staff.

_Article 2.3 _
A prospective visitor is not entitled to a refund of the admission fee or any other
compensation in the event of the loss or theft of the admission ticket before they
enter the museum complex.

If a prospective visitor does not make use of the pre-purchased admission ticket, this is at
the visitor’s own expense and risk; this also applies if the admission ticket is only valid for
a specific time and/or date. Once purchased, an admission ticket cannot be exchanged. Nor will
any refund of the admission fee be made. However, the admission fee paid may be refunded
if circumstances beyond the purchaser’s control make a visit to the museum impossible; this
is, however, at the discretion of the management, and without prejudice to the provisions of Article 2.5.

_Article 2.4 _
A prospective visitor may be denied entry to the museum complex if it transpires that the
admission ticket, discount card or voucher was not obtained from Museum Amersfoort or an
organisation authorised for that purpose by Museum Amersfoort.

_Article 2.5 _
Museum Amersfoort will refund the admission fee actually paid by the visitor and any
travel expenses incurred only if the visitor is required to leave the museum complex prematurely due to an
unannounced emergency response drill (Article 23 of the Working Conditions Act), as well as in the
event of an actual emergency resulting in the total or partial evacuation of the museum complex.

3. Stay within the museum complex

_Article 3.1 _
During their stay within the museum complex, visitors must conduct themselves in accordance with
public order, public decency and the
rules of decorum applicable to the nature of the activity being visited. Visitors are also obliged to follow immediately any directions and instructions given by clearly identifiable
officials of Museum Amersfoort, including but not
limited to attendants and security staff.

If, in the reasonable opinion of an authorised official of Museum Amersfoort, who
must be recognisable as such, the visitor acts in any way contrary to these standards, directions or
instructions, the visitor may be denied further access to the museum complex, without

the visitor having any right to a refund of the cost of the admission ticket or any other
expenses incurred.

_Article 3.2 _
Parents or carers of children are at all times responsible for and liable for the behaviour
of the children they have brought with them. Teachers and group leaders are responsible for and
liable for the behaviour of the group members in their care.

_Article 3.3 _
Visitors are, amongst other things, prohibited from doing the following within the museum complex:
a. offering goods of any kind for sale to third parties, or providing them free of charge;
b. deliberately and persistently blocking the path of other visitors or obstructing their view of exhibited
objects;

c. to disturb other visitors, including but not limited to, through the use
of mobile phones, Walkmans or other sources of noise nuisance; the use of such
equipment may, however, be explicitly permitted by Museum Amersfoort
in certain areas;

d. bringing pets or other animals, unless these are explicitly permitted in certain areas or
in the case of guide dogs (for the blind) accompanying a visitor with an identification card
;
e. smoking, other than in the areas designated for this purpose and indicated by pictograms or text
;

f. to bring in and consume food and drink;
g. to bring in objects or substances deemed dangerous by an official of Museum Amersfoort who is recognisable as such
, including but not limited to
walking sticks, umbrellas or large bags; these may be left at a location designated by Museum

Amersfoort;
h. to use wheelchairs,
prams and pushchairs in areas designated for this purpose by Museum Amersfoort, other than those made available by the museum;

i. to touch exhibited objects and exhibition materials such as display cases, lighting, partitions and
the like, unless this is expressly permitted. Parents or carers of
children must strictly ensure that exhibited objects are not touched by
the children in their care. Young children must be held by the hand or
transported in a pushchair; similarly, teachers and group leaders must ensure that the
members of their group do not touch the exhibited objects.

_Article 3.4 _
In exceptional cases where the general safety of persons or the collection reasonably
so requires, a senior official of Museum Amersfoort, who must be recognisable as such
, may request to inspect the visitor’s hand luggage or other baggage.

If this is
deemed necessary, specially trained staff may also ask the visitor, upon entering or
leaving the museum complex, to cooperate with a security search. Prospective visitors
are warned that this measure is in force before entering the museum complex.

_Article 3.5 _
Unless prior written permission has been granted by the management of Museum Amersfoort,
visitors are prohibited from taking photographs, video recordings or film using lamps,
flash units and/or tripods. Museum Amersfoort may, however, designate areas in which there is a general
ban on taking photographs, filming or making video recordings.

Furthermore, unless prior written permission has been obtained from the management of
Museum Amersfoort, it is prohibited to publish or reproduce photographs, video recordings or films, by
any means and on any medium whatsoever, including electronic media.
_Article 3.6 _
The museum may deny access to the museum complex, either permanently or for a specified period, to any visitor who, during one or more previous visits to a Dutch

museum complex, or who otherwise gives cause to fear
damage,
deny access to the museum complex permanently or for a specified period; in any event, the museum may subject such a visitor, on all their visits, to the
measures referred to in Article 3.4 of these Visiting Conditions.

The decision to deny access must be communicated to this visitor without delay, stating the reasons,
if possible in writing.

4. Complaints and claims

Article 4.1
Museum Amersfoort will do everything in its power to ensure that visits to the museum complex or the exhibitions and activities organised by Museum

Amersfoort, in accordance with the published programme
; this also includes the obligation to inform the public as fully as possible about total,
partial or early closure of the museum complex and/or exhibitions organised by Museum Amersfoort
. Furthermore, Museum Amersfoort shall inform potential visitors about
disruptive maintenance work, refurbishments or the (re)arrangement of spaces. The
visitor may under no circumstances derive a right to compensation from this.

_Article 4.2 _
No claim for compensation may be made in relation to the following complaints and circumstances, which are beyond the control of Museum Amersfoort,
and which therefore never give rise to any obligation on the part of the museum to pay compensation
to the visitor:
a. complaints relating to the non-display of objects from the permanent collection of

Museum Amersfoort;
b. complaints relating to the partial closure of the museum complex,
including, but not limited to, partial closure resulting from the
setting up or dismantling of exhibitions;

c. complaints and circumstances relating to nuisance or inconvenience caused by
other visitors, including, but not limited to, noise nuisance, inappropriate
behaviour, theft and harassment;
d. complaints and circumstances relating to nuisance or inconvenience caused by
maintenance work, including, but not limited to, refurbishment or
the (re)furnishing of rooms;
e. complaints and circumstances relating to nuisance or inconvenience caused by the
malfunctioning of facilities within the museum complex.

Article 4.3

Complaints and claims for reimbursement relating to the agreement between Museum Amersfoort and the
visitor must be submitted in writing to Museum
Amersfoort within six weeks of the visit taking place. Complaints and claims submitted after this deadline will not be
considered. A complaints form is available with these Terms and Conditions of Visit.

Article 4.4
Museum Amersfoort will investigate the complaint and respond in writing within 30 days of receipt.
If the investigation has not yet been completed by then, the complainant will be informed of this, along with the
expected date by which it will be completed.

_Article 4.5 _
Visitors may submit complaints, claims and suggestions for improvement in writing via:
info@museumamersfoort.nl.

5. Liability of the museum

_Article 5.1 _
Visitors’ presence within the museum complex is at their own expense and risk.

_Article 5.2 _
The museum shall only be liable for property damage and/or consequential loss suffered by the visitor, or for
personal injury caused to the visitor, which is the direct and exclusive result of wilful misconduct or gross negligence on the part of the

museum and/or its staff, on the understanding that only such damage is eligible for compensation
as against which the museum is insured, or should reasonably and equitably have been
insured.

_Article 5.3 _
Museum Amersfoort shall never be liable for damage caused to a visitor’s vehicles
except where and to the extent that the damage occurred on or within the museum complex and such damage is the
direct result of wilful misconduct or gross negligence on the part of Museum Amersfoort and/or its staff.

_Article 5.4 _
If Museum Amersfoort takes delivery of goods, or if goods are, in any way whatsoever,
deposited, stored and/or left behind by anyone, without the Museum

Amersfoort has stipulated any remuneration for this, Museum Amersfoort shall under no circumstances be liable for
damage to or in connection with goods arising in any way whatsoever, unless Museum Amersfoort
has caused the damage intentionally, or the damage is the result of gross negligence on the part of Museum Amersfoort.

_Article 5.5 _
Museum Amersfoort’s total liability is at all times limited to compensation for direct
damage and shall in no event exceed the amount of damage for which Museum Amersfoort is insured or
could reasonably and equitably have been insured.

Article 5.6
Even in the event of damage resulting from death or personal injury, Museum
Amersfoort’s total liability shall in no event exceed the damage against which Museum Amersfoort is insured or
could reasonably and equitably have been insured.

Article 5.7
Museum Amersfoort’s liability for indirect damage, including consequential damage,
loss of profit or wages, lost savings, etc., is excluded. Liability for damage
resulting from the actions of third parties, including but not limited to other visitors, is also excluded.

Museum Amersfoort’s liability for damage resulting from failure to follow instructions given by Museum
Amersfoort and its officers and/or staff is likewise excluded.

6. Force majeure

_
Article 6.1 _
Museum Amersfoort shall never be liable for any damage suffered by the visitor arising as
a result of force majeure. Force majeure is defined as any unforeseeable circumstance that impedes the performance of the
agreement by Museum Amersfoort to such an extent that, temporarily or permanently, the performance of the
agreement becomes impossible or unduly difficult, including, but not limited to, industrial action, illness,
fire, disruptions at Museum Amersfoort, intervention by the police and/or fire service, transport problems,
weather conditions, acts of violence, civil unrest or riots.

Force majeure shall also be understood to mean such unforeseen circumstances affecting persons and/or services
and/or institutions utilised by Museum Amersfoort in the performance of the
visitor agreement, as well as anything that constitutes force majeure or a suspensive or
resolutory condition for the aforementioned parties, and any attributable failure on the part of the aforementioned parties.

7. Visitors’ liability

Article 7.1
Visitors to the museum complex are liable to Museum Amersfoort for any damage they
cause, whether or not as a result of a failure to comply with these Terms and Conditions of Visit. Visitors shall indemnify
Museum Amersfoort against any claims from third parties in this regard.

Article 7.2
Parents or carers of children are at all times responsible and liable for the behaviour of,
and any damage caused by, the minors they have brought with them. Teachers and supervisors of
groups are jointly responsible and liable for the behaviour of, and any damage caused by, the
group members under their supervision, without prejudice to the individual liability of these group members themselves.

The aforementioned parents, supervisors, teachers, etc., shall indemnify Museum Amersfoort against
any claims from third parties in this regard.
Article 7.3
Organisations, companies, etc., which organise (or arrange for others to organise) meetings and/or parties (or have them
organised) are at all times responsible and liable for the behaviour of, and any damage caused
by, their guests, without prejudice to the guests’ own liability. The aforementioned
organisations, companies, etc. shall indemnify Museum Amersfoort against any claims by third parties in
this regard.

8. The processing of personal data

Article 8.1
Museum Amersfoort refers visitors to the privacy statement published on its website for
information regarding the processing of personal data and, for example, the related
rights of data subjects.

Article 8.2
Visitors’ personal data is processed in accordance with the GDPR. This concerns
the following: In the context of the performance of the agreement relating to a visit to the museum and
museum complex, (..) processes the necessary visitor data for this purpose. If any parts of this
are carried out by a third party, involving the processing of personal data, a
data processing agreement has been concluded with that third party where required. The personal data in question will be retained
for as long as required by law, including due to tax retention obligations.

Museum Amersfoort processes the personal data of individuals who are guilty of
causing damage to the museum complex or the collection, as referred to in Article 3.6 of these terms and conditions,
as well as those who breach the Visitors’ Terms and Conditions.

Museum Amersfoort maintains a register containing the
details of visitors appearing on this list in order to be able to deny them access. This
register is used solely internally, within the museum itself, and is not disclosed to third parties.

Museum Amersfoort processes the personal data of complainants as referred to in Article 4.3 of these
terms and conditions, or that of the person referred to in Article 4.5 of the terms and conditions. This personal data
will only be processed internally in accordance with its intended purpose, namely to
respond to and resolve the complaint as effectively as possible. The complaint data will only be retained for as long as
is necessary to resolve the complaint, complaint or suggestion and any queries regarding it.

9. Lost property

_Article 9.1 _
Items found by visitors within the museum complex may be handed in at the reception desk.
_Article 9.2 _
Museum Amersfoort will make every effort to trace the owner or rightful claimant of the
lost property and will maintain regular contact with the local police for this purpose.
Lost property for which, after six months in the custody of Museum Amersfoort, no request for collection
has been made by the owner or rightful claimant will be handed over to the local police.

_Article 9.3 _
Should the owner or rightful claimant of a lost property come forward, they may choose either to
collect the items in person or to have them sent to them on a cash-on-delivery basis. In both cases, the
owner or rightful claimant must provide valid proof of identity.

10. Applicable law and competent court

Article 10.1
These Terms and Conditions of Visit and the agreement between the visitor and Museum Amersfoort are
governed by Dutch law.
_Article 10.2 _
All disputes arising from the agreement between the visitor and Museum Amersfoort shall be
submitted exclusively to the competent court in Amersfoort for adjudication.
